These Terms of Service ("Terms") govern your access to and use of the Field Notes mobile application, website, and related services (collectively, the "Service") operated by Field Notes, LLC ("Field Notes," "we," "us," or "our"), a Michigan limited liability company. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent that you have the legal capacity to enter into a binding agreement and that you are not barred from doing so under any applicable law.
2. Accounts
Registration. To access certain features of the Service, you must create an account. You may register using your email address or through Sign in with Apple or Sign in with Google. You agree to provide accurate, current, and complete information and to keep it up to date.
Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at fieldnotesapp1@gmail.com if you suspect unauthorized access to your account. Field Notes is not liable for any loss or damage arising from your failure to protect your account.
One account per person. You may not create multiple accounts, share your account with others, or operate an account on behalf of another person without our written consent.
3. User content
Your content. The Service allows you to submit travel ratings, subcategory scores, reviews, photos, and other content ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant Field Notes a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, adapt, aggregate, display, and distribute your User Content in connection with operating, improving, and promoting the Service, including incorporating your contributions into aggregated destination scores.
Aggregated data. Field Notes owns all rights to the aggregated scores, composite ratings, and derivative data products generated from User Content. Aggregated data is the intellectual property of Field Notes regardless of the underlying individual submissions.
Your representations. By submitting User Content, you represent and warrant that you have all rights necessary to grant the license above, that your content is accurate to the best of your knowledge, and that your content does not violate these Terms or the rights of any third party.
No obligation to publish. Field Notes reserves the right to review, remove, or decline to publish any User Content at our sole discretion, with or without notice, and without liability to you.
4. Community standards
Field Notes is built on the integrity of real traveler data. The value of our ratings depends on honest, firsthand submissions. The following are binding conditions of your use of the Service.
You must:
- Submit ratings and reviews based on your own genuine, firsthand travel experience
- Provide honest, good-faith assessments to the best of your ability
- Accurately represent the destination, time period, and context of your experience
You must not submit content that:
- Is false, fabricated, or based on a destination you have not personally visited
- Is submitted in exchange for compensation, incentives, or at the direction of any business or organization
- Is designed to artificially inflate or suppress the rating of any destination
- Is hateful, discriminatory, harassing, threatening, or abusive toward any individual, group, or community
- Contains sexually explicit material or graphic violence
- Includes personal information about private individuals without their consent
- Infringes any copyright, trademark, or other intellectual property right
- Contains spam, advertising, or promotional content for any product or service
- Violates any applicable law or regulation
Violations of these standards may result in content removal, account suspension, or permanent termination, at Field Notes' sole discretion.
5. Prohibited conduct
You may not:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation
- Attempt to gain unauthorized access to any part of the Service or its underlying infrastructure
- Use automated tools, bots, scrapers, or scripts to access, collect, or extract data from the Service
- Interfere with or disrupt the integrity or performance of the Service
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Use the Service to transmit malware, viruses, or any other malicious code
- Systematically harvest or compile data from the Service to build a competing product or database
- Engage in any conduct that restricts or inhibits any other user from using or enjoying the Service
6. Intellectual property
The Service and all of its content, features, and functionality — including but not limited to the Field Notes name and logo, app design, destination scores, aggregated rating data, and underlying software — are owned by Field Notes, LLC and are protected by United States and international intellectual property laws.
Nothing in these Terms grants you any right to use our trademarks, logos, or other proprietary materials without our prior written consent. Any feedback, suggestions, or ideas you provide to us about the Service may be used by Field Notes without restriction or compensation to you.
7. DMCA and copyright complaints
If you believe that content on the Service infringes your copyright, please send a written notice to fieldnotesapp1@gmail.com that includes: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the allegedly infringing material and its location in the Service; (c) your contact information; (d) a statement that you have a good-faith belief that the use is not authorized; (e) a statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf; and (f) your physical or electronic signature.
Field Notes will respond to valid DMCA notices in accordance with applicable law and reserves the right to terminate the accounts of repeat infringers.
8. Third-party services
The Service may contain links to or integrations with third-party services, including Apple, Google, and Supabase. Field Notes is not responsible for the content, privacy practices, or terms of any third-party service. Your use of third-party services is at your own risk and subject to their respective terms and policies.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIELD NOTES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Field Notes does not warrant that the Service will be uninterrupted, error-free, or secure. Destination ratings, scores, and related information are aggregated from user submissions and are provided for informational purposes only. Field Notes makes no representations about the accuracy, reliability, or suitability of any destination for any purpose. Travel decisions based on information in the Service are made at your own risk.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIELD NOTES AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING DAMAGES ARISING FROM RELIANCE ON ANY RATINGS, SCORES, OR DESTINATION INFORMATION IN THE SERVICE. IN NO EVENT SHALL FIELD NOTES' TOTAL LIABILITY TO YOU EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID TO FIELD NOTES IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless Field Notes, LLC and its officers, members, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of any third party.
12. Termination
Field Notes reserves the right to suspend or permanently terminate your account and access to the Service at any time, for any reason, including but not limited to violation of these Terms, with or without notice and without liability to you.
You may terminate your account at any time by using the account deletion feature within the App. Upon termination, your license to use the Service ends immediately. Sections 3, 6, 9, 10, 11, and 13 of these Terms survive termination.
13. Governing law and dispute resolution
These Terms are governed by the laws of the State of Michigan, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Wayne County, Michigan, and you consent to the personal jurisdiction of those courts.
You agree that any claim must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
14. General provisions
Entire agreement. These Terms, together with the Privacy Policy and End User License Agreement, constitute the entire agreement between you and Field Notes regarding the Service and supersede all prior agreements.
Severability. If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force.
No waiver. Field Notes' failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. Field Notes may assign its rights and obligations without restriction.
15. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "last updated" date above and, where appropriate, by in-app notice or email. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
